Sagt om Dragsdahl-Jensen
Egentlig burde der ikke have hersket tvivl om resultatet. I Information kunne man 19 september læse hvorledes tidligere PET chef Ole Stig Andersen havde vidnet
»PET var af den opfattelse, at Dragsdahl var påvirkningsagent. Han arbejdede for KGB som meningspåvirker.«
Netop påvirkningsagenter var blevet stedse vigtigere for russerne, forklarede den tidligere PET-chef, efter den sovjetiske 20. partikongres i 1956 forlod forestillingen om socialistiske revolutioner i hver enkelt nationalstat. I stedet blev kræfterne brugt på at påvirke opinionen og politikerne i de vestlige lande.
Det var, mens Ole Stig Andersen var chef, at PET i april 1983 oprettede en operationssag på Dragsdahl, som bl.a. indebar telefonaflytning i mere end tre år.
Eftersom Dragsdahl var den eneste danske journalist, efterretningstjenesten på det tidspunkt aflyttede (»det er jeg 99 procent sikker på«, som Ole Stig Andersen formulerede det), blev han som øverste chef orienteret om sagen. Dragsdahl blev i øvrigt også rumaflyttet, fik sin post tilbageholdt og holdt under observation.
Baggrunden for operationssagen mod Dragsdahl var ifølge Andersen, at Information-journalisten havde »usædvanlige konspirative møder med en fremmed efterretningstjeneste«.
Derfor havde Andersen på et møde i embedsmændenes sikkerhedsudvalg også diskuteret Dragsdahls deltagelse i SNU, som var et Sikkerheds- og Nedrustningspolitisk Udvalg, hvor medlemmerne bl.a. modtog klassificeret materiale. Efter aftale med direktøren for Udenrigsministeriet Eigil Jørgensen holdt man inde med at udlevere den slags papirer til SNU-medlemmerne, så længe Dragsdahl deltog: »Vi ville ikke have, at Dragsdahl fik adgang til den slags,« sagde Andersen.
Ifølge hans erindring var embedsmændenes sikkerhedsudvalg enige med ham i opfattelsen af Dragsdahl som påvirkningsagent. Men, understregede Andersen flere gange, det havde intet at gøre med, om der skulle rejses en straffesag om overtrædelse af spionageparagraffen (§ 108) i straffeloven.
»108 er enormt vid. Men det er en politisk vurdering, hvor langt man vil gå,« forklarede Andersen.
»Så når man bruger ordet agent, så var det ikke, fordi man mente, at Dragsdahl kunne straffes efter 108?« spurgte Bent Jensens forsvarer Karoly Németh.
»Nej, det var var en efterretningsterminologi, som vi brugte dengang,« svarede Andersen.
Men der herskede tvivl, ikke blot fordi retssagen i byretten var så bizar. Og den var bizar, som tidligere chefredaktør ved Ekstra Bladet Bent Falbert mindedes i Jyllands-Posten
Den forkerte dom i 2010 i Svendborg ret, hvor det forvirrede kvindemenneske Mette Langborg var retsformand, viser, hvor svært det kan være at føre sådan en sag til sejr.
Hun kasserede Bent Jensens dokumentation og idømte ham bøder, erstatning og sagsomkostninger til sammenlagt 600.000 kr.
Yderligere glemte hun at indkalde kronvidnet Ole Stig Andersen, der var PET-chef 1975-1984, ligesom det lykkedes hendes afdeling at smide retsbogen væk fra en bestemt dag. Det kom frem i landsretten under Bent Jensens ankesag – som flyttede regningen på de 600.000 kr. over på Dragsdahls bord.
Jeg har overværet nogle af møderne i landsretten og undret mig over flere vidners hang til at bortforklare, at Jørgen Dragsdahl var registreret som KGB-påvirkningsagent både i PET’s kartotek og i KGB’s arkiv, hvor han ligefrem blev kaldt ”Nummer 1”.
Der herskede tvivl fordi Østre Landsret også havde sine bizarre indslag. Søren Krarup beskrev i Berlingske Tidende “En episode i Østre Landsret” da historikeren Morten Heiberg, der har skrevet bind 13 i PET-Kommissionens beretning var indkaldt som vidne
Men der blev slet ingen afhøring. Den unge historiker meddelte, at han ikke måtte svare på spørgsmål. Hvorfor dog ikke? spurgte Nemeth forbløffet. Fordi jeg har tavshedspligt, svarede Morten Heiberg.
ALMINDELIG FORBAVSELSE i retssalen. Morten Heiberg har begået et historisk værk. Står han så ikke til ansvar for værkets indhold og konklusion? Morten Heiberg er blevet indkaldt til afhøring for en måned siden, meddelte Karoly Nemeth de tre landsdommere. Han har haft tid til at meddele os sin beslutning for længe siden, og han kan jo ikke hæve et historisk indlæg over spørgsmål og kritik.
Retsformanden undrede sig ligesom alle andre i retssalen, men Morten Heiberg trak et stykke papir op, som var en skrivelse fra justitsministeriet, og som meddelte, at fordi Morten Heiberg havde haft lejlighed til at læse klassificerede PET-dokumenter, kunne han ikke svare på spørgsmål.
»Hvornår er dette brev dateret?« spurgte retsformanden. Morten Heiberg svarede: 1.oktober - dagen før denne afhøring.
MUNTERHEDEN OG OGSÅ forargelsen bredte sig i retssalen. Morten Heiberg havde altså sammen med justitsministeriet udformet et brev, der fritog ham for at stå til regnskab for sit historiske værk, og justitsministeriet og han havde sørget for at datere dette brev så sent, at beslutningen ikke kunne anfægtes og omgøres.
Sådan slipper en historiker for at svare på vanskelige og ubehagelige spørgsmål vedrørende sin historiske fremstilling. Sådan skal man blot alliere sig med et ministerium, hvis der rejses kritik af en redegørelse, som man ikke ønsker diskuteret og anfægtet.
Og Jesper Vind skrev i Weekendavisen at “[h]vis retssagen en dag skulle filmatiseres som en komedie, kunne den passende få titlen Halløj i Landsretten.”
For retssagen, der finder sted i Københavns gamle operabygning i Bredgade, har det ene øjeblik handlet om KGB-agenter, atombomber og storpolitik – for det næste øjeblik at dreje sig om en dansk forsker, der beskyldes for at være en enfoldig og politiserende fusker – for det næste igen at dreje sig om en kvindeglad journalist, der lod sig beværte med udlandsrejser, vodka og dyre frokoster af sovjetiske KGB-folk, og som var »syg af forelskelse«, som en PET-medarbejder skrev i en hemmelig overvågningsrapport.
Halløjet fortsatte, da sagens sidste vidne blev indkaldt. Det var den unge koldkrigshistoriker Morten Heiberg fra den tidligere PET-kommission, der stirrede foragteligt på professor Bent Jensen og nægtede at besvare hans advokats spørgsmål med henvisning til, at Justitsministeriet havde pålagt ham tavshedspligt. Det fik en af tilhørerne – forfatteren Ulla Dahlerup – til at sige indigneret til Jensens advokat: »Hvor er Heiberg dog fræk!«, hvilket fik advokaten til at hviske tørt: »Han er bare en idiot.«
Og halløjet kulminerede forleden dag, da advokaterne – Karoly Németh for Bent Jensen, Henrik Holm-Nielsen for Jørgen Dragsdahl – stod over for hinanden i deres afsluttende sagsfremlæggelse. Den var blevet flyttet til en større retssal på grund af stigende tilskuertilstrømning. Her udførte advokaterne hver deres velgennemtænkte karaktermord på modpartens klient, medens de seneste års danske kulturkamp udgjorde baggrundsmusikken.

Men uanset hvad vil den offentlige interesse hurtigt komme til at handle om Jensens udgivelse af det 1500 sider store værk, Danmark under Den Kolde Krig. Det er et værk, som har været forsinket på grund af forviklinger omkring Jensens brug af PET-dokumenter. Men forlaget Gyldendal oplyser, at værket er klar til at blive trykt med det samme, når dommen falder på fredag.
Hos Jensens støtter vil værket sikkert få status som »koldkrigsbibel«, og omvendt tales der blandt historikere om, at Jensens fjender lige så sikkert ser frem til at »slagte værket«.
For som den unge koldkrigshistoriker Thomas Wegener Friis sagde i landsretten, da han blev bedt om at beskrive Bent Jensens placering i det danske historikermiljø i dag: »Bent Jensen er den historiker, som de skræmmer deres børn med, inden de skal falde i søvn.«
Det er altid skræmmende at blive indhentet af fortiden. Ulrik Høi tog i Politiken da også sorgerne på forskud og erklærede inden dommen at Jensen ville vinde den moralske sejr, Dragsdahl den juridiske
Mit gæt er, at PET har lovet Dragsdahl straffrihed, mod at han fortalte alt om forbindelsen med KGB.
Ligesom præsten og Stasi-agenten Aleksander Radler, der blev afsløret for et par år siden i Sverige. Gennem syv år førte Radler samtaler med det svenske sikkerhedspoliti, Säpo, der lod ham slippe for tiltale og sikrede ham anonymitet, indtil nidkære journalister afslørede ham.
Spekulation og gætteværk, javist, men det er desværre det, som lukkede døre lægger op til.
Værre er det for Bent Jensen, der risikerer at tabe sagen, medmindre forsvaret trækker en kæmpekanin op af hatten.
Men Bent Jensen vandt. Skønt Dragsdahl var krænket var Bent Jensen i sin gode ret til at skrive, som han mente om Dragsdahks aktiviteter på baggrund af de informationer han trods PET modvilje og modarbejdelse havde støvet op i deres arkiver. Og hensynet til forskeres ytringsfrihed skulle veje tungere end både os andres og Dragsdahls manglende lyst til at stå til regnskab for sine handlinger, mente retten. Jørgen Dragsdahl var selvfølgelig rystet over at systemet ikke længere belønnede ham for det undergravende arbejde, hvorved han var steget til magt og ære, kunne man læse i bl.a. Jyllands-Posten
- Det er en underlig dom, siger Dragsdahl.
- I mine øjne ophæver de den danske injurielovgivning, siger han.
- Øjensynlig er det sådan, at hensynet til ytringsfriheden kan dække over fremsættelse af en stribe falske påstande, siger han til pressefolkene efter dommen.

Dragsdahl skal betale modparten 600.000 kroner i sagsomkostninger. Han kan ikke umiddelbart anke afgørelsen til Højesteret. Det kræver i givet fald en særlig tilladelse af Procesbevillingsnævnet.
Derudover må Jørgen Dragsdahl forholde sig til, om han har råd til en eventuel ankesag.
- Det er ikke kun et spørgsmål om ret eller uret, men også om økonomiske ressourcer, og jeg sidder ikke på nogen guldgrube, siger Jørgen Dragsdahl.
Jørgen Dragsdahls advokat, Henrik Holm Nielsen, har tidligere oplyst, at han har arbejdet over 1000 timer med sagen, siden ankesagen blev anlagt. I den oprindelige sag brugte han 1600 timer. Dragsdahls udgifter til advokat er under sagen løbet op i over 2,5 millioner kroner.
Den sorg er nok tabt på Bent Falbert der intet havde glemt havde glemt fra dengang Dragsdahl og støtter trynede ham og hans avis til at trække sandheden tilbage
Det er ikke kun professor Bent Jensen og Jyllands-Postens redaktion, som er glade for den dom, som Østre Landsrets 17. afdeling afsagde i fredags.
Vi gamle i gårde på Ekstra Bladet er også tilfredse med afgørelsen. Vi har ventet på retfærdigheden i 20 år.
I 1992 – året efter Sovjetunionens sammenstyrtning – bragte vi en artikelserie om danskere, som havde bistået KGB på vekslende vis.
Blandt de mest fremtrædende var Jørgen Dragsdahl, udenrigsmedarbejder på Dagbladet Information 1977-1995 og 1981-1983 medlem af regeringens Sikkerheds- og Nedrustningspolitiske Udvalg. Desuden bistod han Socialdemokratiet og SF som rådgiver under 1980’ernes kamp i Folketinget om sikkerhedspolitiske dagsordener. Navnlig stod han to folketingsmedlemmer, socialdemokraten Lasse Budtz og folkesocialisten Gert Petersen, nær.
Ekstra Bladet rullede op, hvordan Jørgen Dragsdahl havde holdt konspiratoriske møder med KGB-officerer i Danmark og i Wien. Han blev skildret som en energisk påvirkningsagent, der blev styret af Sovjets efterretningscenter i ambassaden i København.
Avisens kilder var bl.a. ledende medarbejdere i PET, så vi var rimeligt trygge ved oplysningernes validitet. Men Dragsdahl gik straks til modstand og forlangte artiklerne berigtiget. Da vi afslog, stævnede han os.
Nu gjaldt det om at dokumentere vore påstande præcist med dokumenter og vidneudsagn. Men så langt strakte PET’s hjælpsomhed ikke. Socialdemokraten Erling Olsen, der var justitsminister 1973-1974, var heller ikke leveringsdygtig i beviser, da han havde talt med sit formørkede bagland.
Med udsigt til at tabe en retssag fulgte vi – tænderskærende – advokaternes råd om at indgå forlig med Østre Landsrets assistance.
Den 13. december 1994 måtte Ekstra Bladet beklage, at vi havde omtalt Dragsdahl som KGB-agent, der havde modtaget betaling for at udsprede disinformation. I tilgift fik han 125.000 kr. i torterstatning.
Det var en mørk dag på avisen. Vi følte, at vi havde ret – men ikke kunne få ret.
Men der ligger altså en regning på 3,5 mill. til Dragsdahls støtter og som man kunne læse om i Jyllands-Posten allerede ved den første retssag, plejede de at omfatte bl.a. “En stribe tidligere ministre fra S, R og CD ”, som også dummernikken Steen Folke
Ud over Kjeld Olesen og Mogens Lykkestoft drejer det sig bl.a. om tidligere justitsminister Ole Espersen (S), tidligere indenrigsminister Birthe Weiss, tidligere økonomiminister Marianne Jelved, tidligere miljøminister Lone Dybkjær og tidligere minister og leder af CD, Mimi Jakobsen. Derudover har bl.a. biskop Kjeld Holm, filosoffen Peter Kemp, og de forhenværende folketingsmedlemmer Jens Bilgrav-Nielsen (R) og Steen Folke (Venstresocialisterne) bidraget.
Der er også kommet støtte fra menneskeretsadvokaten Sune Skadegaard Thorsen, historikeren Kristian Hvidt, professor Ole Lange, professor Nikolaj Petersen, professor Uffe Østergaard og professor Øjvind Lidegaard.
Blandt journalister, der støtter, er tidligere chefredaktør på Information, David Jens Adler, journalist Flemming Ytzen, journalist Jens Lohmann, redaktør Ove Weiss og redaktør Jacob Andersen. Foreningen Informations venner støtter også indsamlingen.
Desværre har de røde jo penge nok, penge de gerne har tjent i fede offentlige stillinger, mens de aktivt og med forsæthar skadet Danmark. Jyllands-Posten konkluderede i deres leder
Dommen bekræfter, at det var en KGB-agent, der stod bag 1980’ernes fodnotepolitik.
Østre Landsrets frifindelse af professor Bent Jensen er meget andet og mere end afgørelse af en strid mellem to enkeltpersoner. Det er intet mindre end en officiel bekræftelse af det faktum, at det var en KGB-agent, der stod bag 1980’ernes ødelæggende fodnotepolitik, som truede Danmarks forhold til Nato.

En fremtrædende sikkerhedspolitisk skribent og en gruppe socialdemokratiske folketingsmedlemmer støbte i fælleskab fundamentet til fodnotepolitiken, og det kan nu siges åbent, at den ene af disse arkitekter var KGB-agent.
Katrine Winkel Holm lagde også lidt nuancer ind af Dragsdahls virke
Selv om Dragsdahl ved Gud ikke er en stor mand, har retssagen mindet os om hans lille, usle rolle.
Som f. eks. i denne passus, der blev citeret af Bent Jensens sagsfører, Karoly Németh. Her fortæller en eks-kommunist, hvor stor glæde kommunisterne dengang havde af Dragsdahl: »Vi var målløse over at få leveret så megen prosovjetisk ammunition (fra Dragsdahl, KWH)… for selv om Sovjet knagede i fugerne under Reagans pres, fortsatte Jørgen Dragsdahl med at levere varen. Som propagandist og leverandør af argumenter fik han status og en indflydelse, som ingen kommunist kunne have fået.« Men kommunisten, der hér fører ordet, er ikke længere kommunist og konkluderer derfor: »Hvis jeg i dag kunne stå inde for, hvad jeg dengang stod for, ville jeg være Dragsdahl dybt taknemlig.
Men i dag kan jeg se, at det var en halv milliard mennesker, som fik en elendig og uværdig tilværelse forlænget på grund af ham. Måske kun nogle timer. Eller bare minutter.
Det forekommer selvmodsigende at betegne Dragsdahls rolle som lille og ussel når man samtidig har øje for hans betydning for “en halv milliard mennesker, som fik en elendig og uværdig tilværelse forlænget på grund af ham”. Men hun er jo kvinde og skriver med sine følelser. Mere nøgtern er Ole Hasselbalch, der slår fast, hvad der ikke er sandt ved Dragsdahls ævlerier omkring retten
Jørgen Dragsdahl og hans støttekreds er nu begyndt at omskrive og bortforklare domsresultatet i landsretten.
Dommen siger,
- at Bent Jensen havde faktuelt belæg for at skrive, at PET som institution betragtede Dragsdahl som KGB-agent,
- at Dragsdahl drev desinformation i den forstand, i hvilken BJ havde brugt dette ord,
- at BJ med hjemmel i den tolkning af straffeloven, Menneskerettighedskonventionen tilsiger, havde ret til at bringe disse oplysninger i pressen i kort, populariserende form.
Retten noterer, at der ikke blev ført bevis for, at Dragsdahl faktisk var indflydelsesagent. En sådan bevisførelse var unødvendig, eftersom BJ ikke i de påklagede artikler havde skrevet noget sådant.
Der er således IKKE sandt, når Dragsdahl nu hævder, at Menneskerettighedskonventionen har sat injurielovgivningen ud af kraft og åbner for, at der kan offentliggøres ”falske påstande”. Bevisligt sande injurier har altid kunnet viderebringes, og BJ førte bevis for, at han havde tilstrækkeligt faktuelt belæg i PET’s papirer for det, han skrev, der stod i dem.
Det er således IKKE sandt, når Dragsdahl fortæller, at landsretten fastslår, at det, BJ skrev, var forkert, og at BJ iht. dommen kan ”lyve og svindle”.
Det er således IKKE sandt, når Dragsdahl fortæller, at BJ skrev, at Dragsdahl var agent.
Det er IKKE sandt, som Dragsdahl hævder, nemlig at PET aldrig har ført bevis for, at han var indflydelsesagent. Det ved vi intet om. Men man har lov til at gå ud fra, at PET havde belæg for at bruge betegnelsen over for statsministeren, udenrigsministeriet og de udenlandske allierede tjenester, til hvem oplysningen om Dragsdahl som indflydelsesagent blev videregivet. Det vides også, at dette belæg var tre KGB-kilder samt PET’s egne efterforskninger.
Det er IKKE sandt, når Dragsdahl siger, at han har søgt at få alle PET-papirer offentliggjort. Han nægtede f.eks. at medvirke til, at mere end nogle få af telefonaflytningsrapporterne kunne fremlægges i retten.
Det er IKKE sandt, at tre tidligere PET-chefer ikke mente, han var indflydelsesagent. De mente, at det ikke kunne bevises, at Dragsdahl havde gjort sig skyldig i STRAFBARE forhold. Og de kørte under afhøringerne rundt i begreberne på en måde, som altså fik landsretten til at se bort fra deres vidneudsagn. En indflydelsesagent behøver i parentes bemærket ikke gøre noget som helst strafbart.
Det er IKKE sandt, at PET’s efterforskning sluttede med at konkludere, at mistanken imod Dragsdahl for (indflydelses)agentvirksomhed var uberettiget. PET indstillede først overvågningen på det tidspunkt, hvor KGB opdagede, at han var afsløret, hvorefter han ikke mere var brugbar som indflydelsesagent.
Det er IKKE sandt, at det aldrig er bevist, at Dragsdahl skrev efter KGB-inspiration. Det modsatte har landsretten anført flere eksempler på i domskonklusionen.
Det er IKKE sandt, at Dragsdahl fik sit materiale afvist af landsretten. Retten gennemlæste det, han fremlagde, men forkastede altså dets værdi.
Det er IKKE sandt, at BJ ikke har været kildekritisk nok. BJ kom med en omfattende redegørelse for sin kildekritik i retten, som altså anså den for fuldt tilstrækkelig.
Mange jurister og kommentatorer har forklaret, hvad dommen drejede sig om, hvis ikke man gad læse den selv, men allerbedst var Thomas Fog’s forklaring, som han skrev på Facebook
Vedrørende landsrettens lysende klare dom:
Når en person går med slips, skjorte, jakke og bukser med bulen på rette sted, dertil har en dyb stemme, angiveligt har fået tre børn med sin kone, som desværre nu er død, når der synligt tilmed gror skæg i ansigtet og hår ud af både næsebor og begge ører på ham, er der på den ene side ikke ført sandhedsbevis for, at personen virkelig er en mand, for den eneste, der faktisk har set hans diller, er jo desværre død. På den anden side vil Bent Jensen trods alt have grund til at tro og sige, at andre mener, at personen faktisk er en mand, fordi også mandens egen læge ifølge journalerne er gået ud fra, at han nok er en mand, og at han ifølge sin egen kones udsagn har været nummer 1, da de i sin tid fik børn sammen. At Bent Jensen derfor har fået rettens ord for, at han godt må tro og sige, at det forholder sig som lægen og konen siger, bare han ikke påstår, at det faktisk forholder sig sådan - det er en stor landvinding, der må betegnes som en sejr for den personlige ytringsfrihed og den relative sandsynlighedsværdi af de observationer, andre støtter sig til.
